ERGELYA Privacy Policy
Last Updated: May 1, 2026
ERGELYA ("we," "us," or "our") operates ergelya.com, including our store offering AirCloud™ air seat cushions and related products, and the associated content, features, tools, and services (the "Services"). Shopify provides the platform that powers our store. This Privacy Policy explains how we collect, use, and disclose personal information when you browse our website, place an order, contact us, or otherwise use the Services. If our Terms of Service conflict with this policy concerning personal information, this policy governs that subject.
Please review this policy to understand our information practices and your choices. This policy provides notice of those practices; it does not replace consent where consent is required by applicable law.
Personal Information We Collect or Process
Personal information means information that identifies you or can reasonably be connected with you. It does not include information that has been anonymized so that it cannot reasonably identify you. Depending on your interactions with us, we may process:
- Contact details: your name, email address, telephone number if provided, and billing and shipping addresses.
- Financial information: payment method, payment status, transaction amount, payment confirmation, and limited payment details made available to us. Shopify and payment providers process payments. This does not mean ERGELYA receives or stores your full payment card number or security code.
- Account information: details associated with a customer account, if you use one, and your preferences and settings.
- Transaction information: products viewed, items added to a cart, purchases, order numbers, delivery details, and cancellation, return, refund, or voucher records.
- Communications with us: support emails, feedback, and photographs or videos you choose to submit about an AirCloud™ cushion or another product, including evidence relating to a damaged or defective item.
- Device information: IP address, device and browser characteristics, network information, cookie identifiers, and similar identifiers.
- Usage information: pages visited, referral sources, product interactions, cart and checkout events, and interactions with marketing communications where tracking is used.
Please do not send medical records, passwords, full payment card details, or unrelated personal information in support requests. Photographs and videos submitted for a product claim should focus on the product and the reported issue.
Personal Information Sources
We may receive personal information:
- Directly from you, when you order, contact support, submit product evidence, subscribe to emails, or use a customer account.
- Automatically through the Services, through cookies, pixels, and similar technologies used when you browse or interact with our store.
- From service providers, including Shopify and providers supporting payments, fulfillment, delivery, communications, and website operations.
- From partners and other third parties, including Google Analytics, Meta business tools, and fulfillment partners, depending on the services used and applicable privacy choices.
How We Use Your Personal Information
We may use personal information for these purposes:
- Provide, Tailor, and Improve the Services. Process orders and payments, arrange delivery, send order updates, manage accounts where offered, remember preferences, and improve our products and shopping experience. We also use relevant information to review cancellation requests, product issues, refund claims, and voucher requests under our applicable policies.
- Marketing and Advertising. Measure advertising performance and show relevant advertisements, including on Facebook and Instagram, subject to applicable law and privacy choices. If we send promotional emails, we do so based on subscription choices or another basis permitted by law. Purchasing a product does not itself constitute marketing consent where consent is required.
- Security and Fraud Prevention. Protect checkout and accounts, detect suspicious transactions or misuse, investigate fraud, and secure the Services.
- Communicating with You. Answer questions, provide support, and communicate about purchases, deliveries, product claims, and other service matters.
- Legal Reasons. Maintain required records, comply with applicable obligations and valid legal requests, resolve disputes, and protect or enforce our rights and policies.
Submitting a photograph, video, or other evidence for a support claim does not authorize us to publish it as a testimonial or use it in advertising. We would request separate permission for those uses.
How We Disclose Personal Information
We may disclose relevant information:
- To Shopify and service providers supporting hosting, checkout, payment processing, fraud prevention, communications, technical services, and business administration.
- To fulfillment and shipping partners, including DSers and suppliers accessed through AliExpress where used to fulfill your order. We provide the recipient and order details needed to source products, arrange delivery, and resolve fulfillment issues. These partners may be located outside the United States.
- To analytics and advertising partners, including Google and Meta, to understand website use, measure campaigns, and support relevant advertising, subject to applicable requirements and privacy choices. Advertising disclosures may qualify as a "sale," "sharing," or "targeted advertising" under some privacy laws even if we do not receive money for the information.
- At your direction or with your consent, for example when you request a particular service or authorize a disclosure.
- To professional advisers, authorities, or other appropriate recipients when needed to comply with law or valid legal process, investigate fraud, resolve disputes, or protect rights and safety.
- In a business transaction, such as a merger, acquisition, sale, or insolvency process, subject to applicable protections.
Some recipients process information under their own privacy policies and legal responsibilities. We limit disclosures to information relevant to the purposes described here.
Relationship with Shopify
Shopify hosts our store and processes personal information to provide and support the Services, including checkout and other store functions. Information submitted to our store may be processed by Shopify and its providers in countries other than your own.
If we enable optional features such as Shopify Network Intelligence or related enhanced services, Shopify may also process information about your interactions with our store together with information from other merchants and Shopify to improve services and support personalization or advertising, subject to applicable settings, requirements, and choices. Where Shopify processes information for its own purposes, Shopify is responsible for that processing and the associated privacy requests.
Learn more in the Shopify Consumer Privacy Policy. You can also visit the Shopify Privacy Portal to learn about choices and requests relating to information processed by Shopify.
Third Party Websites and Links
Our Services may link to websites or platforms operated by others. Their privacy and security practices are governed by their own policies. Review those policies before providing information. A link does not by itself indicate our endorsement of the website or its operator.
Information you post publicly, including on social media or in a public review, may be visible to other people. Please consider what you include before posting.
Children’s Data
Our Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact us so we can investigate and take appropriate action, including deletion where required.
We do not knowingly sell or share the personal information of anyone under 16 for targeted advertising.
Security and Retention of Your Information
We use reasonable safeguards to protect personal information, but no transmission method or storage system can be guaranteed completely secure. Do not email passwords or full payment card details.
We retain information for as long as reasonably needed for the purposes described in this policy, including order fulfillment, support, claim handling, required recordkeeping, dispute resolution, and legal obligations. Retention varies by information type and purpose. Product claim photographs and videos are retained as needed to review the claim and address related obligations or disputes.
Your Rights and Choices
Depending on your location and applicable law, you may have the following rights, subject to legal conditions and exceptions:
- Right to Access / Know. Request information about our processing and access to personal information we hold about you.
- Right to Delete. Request deletion of personal information, subject to exceptions such as required recordkeeping.
- Right to Correct. Request correction of inaccurate personal information.
- Right of Portability. Request a copy of certain personal information in a usable format and, where applicable, its transfer to another provider.
- Right to Opt out of Sale or Sharing for Targeted Advertising. Request that we stop disclosures or processing that qualify as a sale, sharing, or targeted advertising under applicable law. Email support@ergelya.com with the subject "Privacy Request" or use the data-sharing opt-out controls on our website where available. Where required by applicable law, we honor recognized opt-out preference signals such as Global Privacy Control. Browser-based choices may apply to the current browser or device; contact us for assistance with information linked to your account or orders.
- Managing Communication Preferences. Unsubscribe from promotional emails using the link in those emails or by contacting us. We may still send necessary messages about orders, payments, refunds, security, and support.
Cookies, Analytics, and Advertising Choices. We use cookies and similar technologies for essential store functions, analytics, and advertising. Google Analytics helps us understand website activity. Meta Pixel and related Meta business tools help measure product views, cart additions, purchases, and advertising results and support advertising on Facebook and Instagram. Depending on configuration and privacy choices, these tools may receive device identifiers and browsing or purchase events.
Learn more about Google’s use of information from partner sites and the Meta Privacy Policy.
Where consent is required, non-essential tracking requires your consent. You can manage cookie choices through website controls where displayed, adjust browser cookie settings, or contact us for help. Browser settings alone may not stop every form of advertising-related data disclosure. Blocking cookies may affect some store functions.
To exercise your rights, email support@ergelya.com with the subject "Privacy Request" and describe your request. Where applicable, you may also have rights to restrict or object to processing, withdraw consent without affecting the lawfulness of earlier processing, or limit certain uses of sensitive information.
We may request information reasonably needed to verify your identity for requests requiring verification. We do not require verification for opt-out requests where prohibited by law. An authorized agent may submit a request subject to applicable authorization and verification requirements. We respond within the time required by applicable law and do not unlawfully discriminate against people for exercising privacy rights.
For information processed by Shopify for its own purposes, visit the Shopify Privacy Portal.
Complaints
Contact support@ergelya.com if you have concerns about our information practices. If applicable law gives you a right to appeal a denied privacy request, contact that address with the subject "Privacy Appeal". You may also complain to the regulator or data protection authority with jurisdiction over your concern.
International Transfers
Shopify, fulfillment partners, suppliers, and other providers may store or process information outside your state or country. Privacy laws in those locations may differ from those where you live.
Where applicable law requires safeguards for international transfers, those transfers must use an appropriate legal mechanism. For transfers subject to European Economic Area or United Kingdom requirements, this may include an adequacy decision, approved standard contractual clauses, or another legally permitted mechanism, as applicable to the provider and transfer.
Changes to This Privacy Policy
We may revise this policy to reflect changes to our practices, services, or applicable requirements. We will post the revised policy, update the date above, and provide additional notice or request consent where required by law.
